根据意大利最高行政法院（国务委员会）最新裁定——暂缓执行意大利5万欧元保证金缴纳义务，等待进一步审理！但令人意外的是，尽管法院已裁定暂缓执行，作为财务代表，沙之星跨境仍收到了意大利税局的催缴通知，也就是要求我们的客户必须在60天内完成5万欧元保证金的缴纳，否则将影响VAT/VIES资格。
对此，沙之星跨境已在第一时间正式向意大利税局发函申诉，明确反驳并指出该保证金法规目前已被意大利最高行政法院暂停执行，税局无权在法律暂停期间强制要求客户缴费。除此之外，在8月13日的沙之星意大利专场直播中，沙之星创始人&CEO Amy Ai也首次公开了沙之星跨境与意大利税局最新的沟通成果与经验。
核心内容包括：

Oggetto: Richiesta di sospensione azione esecutiva – Ordinanza Consiglio di Stato n. 2323/2025
Gentile Agenzia delle Entrate,
in riferimento alla Vostra recente comunicazione riguardante l’inclusione dei nostri clienti nella banca dati VIES e la correlata richiesta di presentazione di una garanzia, desideriamo informarVi quanto segue.
Con ordinanza del 27 giugno 2025 (n. 2323), il Consiglio di Stato ha sospeso l’obbligo di presentazione della garanzia assicurativa previsto dal Vostro provvedimento. Tale sospensione rimane in vigore fino a nuova decisione, con effetto immediato.
Alla luce di quanto sopra, riteniamo che la richiesta di garanzia per i nostri clienti non trovi, allo stato attuale, fondamento giuridico e chiediamo pertanto che venga revocato l’avviso di esclusione dei relativi numeri di partita IVA dalla banca dati VIES.
Vi invitiamo gentilmente a confermare che la presente posizione sarà rivalutata e che l’azione esecutiva sarà sospesa, in coerenza con l’ordinanza del Consiglio di Stato.

Subject: Request for Suspension of Enforcement – Council of State Order No. 2323/2025
Dear Revenue Agency,
With reference to your recent communication regarding the inclusion of our clients in the VIES database and the related requirement to submit a guarantee, we wish to bring the following to your attention.
On 27 June 2025, the Council of State, through Order No. 2323, suspended the obligation to present the insurance guarantee as set out in your provision. This suspension remains in effect until further notice, with immediate applicability.
In light of this, we believe that the current request for our clients to provide a guarantee is without legal basis, and we therefore respectfully request the withdrawal of the enforcement notice regarding the exclusion of their VAT numbers from the VIES database.
We kindly ask you to confirm that this matter will be reconsidered and that the enforcement action will be suspended in line with the above-mentioned Council of State order.
We remain at your disposal to provide any additional information or documentation that may assist in resolving this matter.
